These Terms of Service govern your use of the SaferChatAI Discord bot (the "Bot" or "Service"). By installing, activating, or using the Bot, you agree to these Terms. If you do not agree with these Terms, do not use the Bot.

The agreement for use of the Bot is between you as the user or server administrator and the provider listed above.
SaferChatAI is a Discord bot that supports content moderation on Discord servers. The Bot uses artificial intelligence (AI) to analyze messages and identify potentially problematic content that may violate community guidelines.
The Service includes:
By default, the Bot does not make automatic moderation decisions such as deleting messages, issuing warnings, or imposing timeouts or bans. The Bot reports potentially problematic content to the moderation team, which then conducts human review and makes decisions.
Optional auto-delete: Server administrators can optionally enable automatic deletion of flagged messages. This is not the default setting and must be explicitly activated.
The Service is currently in beta phase. This means features may not be fully developed, errors can occur, and changes to functionality may be made. We strive for maximum stability and quality but cannot guarantee error-free operation.
To use the Bot, you need:
You must be at least 16 years old to use the Bot independently. Use by persons under 16 is only permitted with explicit consent from a parent or legal guardian. By using the Bot, you confirm that you meet the required minimum age or have the necessary consent.
Installation of the Bot occurs through Discord's OAuth2 interface. You authorize the Bot to perform certain permissions on your server, including:
You can revoke the Bot's permissions or remove the Bot from your server at any time.
You agree to use the Bot only lawfully and in accordance with these Terms, applicable laws, and Discord's Community Guidelines.
The following actions are expressly prohibited when using the Bot:
As a server administrator, you are responsible for content and user behavior on your Discord server. The Bot serves only as a support tool for moderation. Final responsibility for moderation decisions and compliance with laws and guidelines rests with you.
You are obligated to keep your Discord login credentials and administrative access to your server secure and protected from unauthorized access. Do not share your credentials with third parties.
We strive for maximum availability of the Bot. However, we cannot guarantee 100% availability. The Service may be temporarily interrupted at any time for technical reasons, maintenance, security fixes, or updates.
Planned maintenance will be announced in advance when possible. Emergency maintenance may occur without prior notice.
We reserve the right to change, expand, or restrict the Bot's functionality at any time. This includes:
Significant changes that substantially affect your use will be announced in advance when possible.
We reserve the right to permanently discontinue the Service at any time. In this case, we will provide at least 30 days' advance notice when possible.
During the beta phase, use of SaferChatAI is completely free. There are no fees, subscription costs, or other charges.
After the beta phase concludes, we reserve the right to introduce paid plans. Beta users will be informed in advance and will receive:
Introduction of paid plans will be communicated at least 60 days in advance. You will then have the option to continue using the Service free of charge under the basic plan, upgrade to a paid plan, or discontinue use.
There is no legal claim that the Service will remain free permanently. However, beta users will receive preferential terms as described in Section 6.2.
All rights to the Bot, including source code, algorithms, AI models, design, trademarks, logos, and other intellectual property rights, remain with the provider. These Terms grant you only a limited, non-exclusive, non-transferable, and revocable right to use the Bot in accordance with these Terms.
Use of the Bot does not grant you ownership or licensing rights to the Bot or its components. Any reproduction, modification, distribution, or other use beyond what is permitted here is prohibited without express written permission.
If you provide us with feedback, suggestions, or ideas for improving the Bot, you grant us an unlimited, worldwide, royalty-free, and irrevocable right to use, exploit, and integrate that feedback into the Bot without any claims arising to you.
We are fully liable for damages caused by intentional or grossly negligent conduct by the provider, its legal representatives, or agents.
For damages arising from injury to life, body, or health, we are fully liable even in cases of slight negligence.
For slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to foreseeable, typically occurring damages. Essential contractual obligations are those whose fulfillment enables proper contract performance and on whose compliance you may regularly rely.
Otherwise, our liability is excluded to the extent legally permissible. This applies in particular to:
Important Notice:
The Bot uses artificial intelligence to analyze content. AI systems are not infallible. False positives (incorrect flags of harmless content) and false negatives (missed problematic content) can occur. We provide no guarantee for the accuracy, completeness, or reliability of AI analyses.
The Bot does not replace human moderation. Server administrators and moderators remain responsible for final moderation decisions and compliance with laws and community guidelines.
We are not responsible for content created or shared by users on Discord servers. Responsibility for user-generated content lies with the respective user or server administrator.
Liability under product liability laws and other mandatory legal liability provisions remains unaffected.
You agree to indemnify the provider against all third-party claims arising from your use of the Bot, your violation of these Terms, or your infringement of third-party rights. This includes reimbursement of reasonable legal defense costs.
The indemnification obligation does not apply to the extent you are not responsible for the legal violation.
Processing of personal data in connection with use of the Bot is governed by our Privacy Policy, available at:
By using the Bot, you agree to the processing of your data in accordance with the Privacy Policy.
You may terminate use of the Bot at any time without notice by removing the Bot from your Discord server. No formal termination is required.
We reserve the right to suspend or terminate your access to the Bot for violations of these Terms, abusive use, or for good cause.
Good cause exists in particular when:
For good cause, we may suspend or terminate access without notice. In less serious cases, we will first issue a warning with reasonable opportunity to remedy.
Upon termination of use, your right to use the Bot expires. Stored data will be handled according to our Privacy Policy and deleted after expiration of retention periods.
We reserve the right to modify these Terms at any time. Changes may be necessary due to legal developments, technical changes, adjustments to functionality, or business decisions.
You will be informed of changes to the Terms in advance, typically at least 30 days before the changes take effect. Notice will be provided by email (if provided), through a notification on Discord, or via our website.
You have the right to object to changes within 30 days of receiving the change notice. If you do not object, the modified Terms are deemed accepted. If you object, you are entitled to terminate use of the Bot. We will specifically inform you of these consequences in the change notice.
Changes to Terms do not have retroactive effect and only affect future use of the Bot.
If any provisions of these Terms are or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. In place of the invalid or unenforceable provision, a valid and enforceable provision shall be deemed agreed upon that comes closest to the economic purpose of the invalid or unenforceable provision.
These Terms and all legal relationships between you and the provider are governed exclusively by the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and private international law.
If you are a consumer with habitual residence in another EU member state, mandatory consumer protection provisions of that state remain unaffected by this choice of law.
If you are a business, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is the provider's location in Innsbruck, Austria.
For consumers, statutory places of jurisdiction apply.
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr.
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
